Biography

Wes Achey is a member of Alston & Bird’s Intellectual Property Litigation Team. Wes’s practice includes all areas of intellectual property litigation and counseling, with a particular emphasis on patent litigation and enforcement. He has represented clients in patent infringement lawsuits in federal district courts across the United States, including cases involving telecommunications, computer software and various mechanical devices. He is a member of the Georgia Bar and is also registered to practice before the U.S. Patent and Trademark Office.

Wes received his J.D., magna cum laude, in 2004 from the Georgia State University School of Law, where he served as associate editor of the Georgia State Law Review. He earned his B.S. in industrial engineering in 2001 from the Georgia Institute of Technology, graduating with honors.

Represented complainant Nokia in this offensive investigation brought against HTC Corporation and HTC America, Inc. The six U.S. patents asserted covered a range of technologies used in portable communication devices. Due in part to a finding of infringement on two Nokia patents in Inv. No. 333-TA-847, a global settlement was reached in March 2014.
  • Nokia Solutions, Network US, LLC and Networks Oy – Eastern District of Texas
We represent Nokia Solutions and Network US LLC and Nokia Solutions and Networks Oy in a series of offensive and defensive patent actions in the Eastern District of Texas involving infringement or claimed infringement of more than 30 patents related to data and signal processing. These actions are ongoing.

  • Nokia Technologies Oy – International Patent Infringement
We represented Nokia Technologies Oy in a series of patent infringement actions involving 40 Nokia patents relating to video coding and compression. Recently, Apple agreed to an upfront cash settlement along with the payment of additional revenues, settling these actions domestically and worldwide. Foreign actions involved 10 countries in Asia and Europe, including Germany, Italy and Japan.

No. 337-TA-1039; Certain Electronic Devices, Including Mobile Phones, Tablet Computers and Components Thereof, U.S. ITC Inv. No. 337-TA-1038; Nokia Technologies Oy, et al. v. Apple Inc., No. 2:16-cv-1440 (EDTX); and Nokia Technologies Oy, et al. v. Apple Inc., No. 2:16-cv-1441 (EDTX).
  • Autoliv ASP Inc. v. Hyundai Mobis Co. Ltd., No. 2:13-cv-00141
Alston & Bird filed a patent infringement lawsuit on behalf of Autoliv ASP Inc. against Hyundai Mobis and Mobis Alabama in the Middle District of Alabama. The lawsuit involves two patents, both directed to passenger airbag safety features that prevent injuries when occupants are too close to the airbag when the airbag deploys in an accident. The defendants filed petitions for inter partes review (IPR) of both patents-in-suit. We filed preliminary responses, which resulted in only partial institution of the IPR proceedings. We have won all appeals to the Federal Circuit. Following trials in the IPRs, the Patent Trial and Appeal Board (PTAB) issued a final written decision that the claims of the lead patent are not invalid, even though the vast majority of instituted IPRs end in the invalidation of the challenged claims.
