Warren Hutchison is a Partner in Freeman Mathis & Gary's Boston and Providence offices. He is a trial and appellate lawyer with experience in a broad range of civil litigation matters for both corporate and individual clients. Mr. Hutchison's areas of practice include unfair competition, trademarks, trade secrets, partnerships, breach of warranty, intellectual property, professional liability of architects, engineers, attorneys, accountants, investment advisors, financial planners, real estate brokers, and surveyors, toxic torts, personal injury, employment and environmental claims. Mr. Hutchison has experience in the litigation and settlement of class actions and antitrust claims.

Mr. Hutchison's experience in the financial and securities industry includes defending disputes arising out of (1) the purchase and sale of securities and obligations of financial institutions to commercial and individual customers and competitors, (2) lender liability and (3) credit reporting. He has consulted with the pharmaceutical industry on anticompetitive and antitrust implications of drug pricing and represented an electronics company in trade secret litigation involving microwave communications technology.

He has successfully defended a claim that a private placement memorandum contained misleading statements that caused bond purchasers $50 million in losses; defended a national law firm in a class action complaint arising out of tax shelters; defended financial planners against claims of unsuitable investments; and defended a brokerage firm in a claim arising out of employee theft of investors' money. Mr. Hutchison has also acted as an arbitrator in NASD customer and employment disputes.

Mr. Hutchison has successfully defended design professionals where owners and developers have sued for malpractice and breach of contract and sought recovery for project delays, lack of design coordination, design and construction defects, the release of environmental hazards, structural failures, and gas explosions, as well as claims by contractors for project delays, additional costs of construction, failure to administer construction activities professionally and unfair and deceptive practices. He has successfully tried or mediated claims involving professional sports stadiums, airport and land-based rail transit, airport terminal buildings, university classroom buildings and dormitories, museums, primary and secondary schools, auditoriums, condominiums, luxury homes, roads, bridges, sewers, underground and above-ground water storage structures, and power plants including co-generation systems.

He has also litigated intellectual property disputes involving copyright and trademarks, water distribution and engineering feasibility studies and local, state and federal accessibility issues. He has obtained numerous favorable arbitration awards where the issues involved alleged deficiencies in architecture, civil engineering, and marine engineering, including claims for delays, extra expense due to insufficient plans and specifications, failed building materials, and structural collapses.

Success has also been achieved in personal injury actions. In addition to his trial and appellate advocacy, Mr. Hutchison has successfully resolved hundreds of cases in mediation and direct settlements.Mr. Hutchison has also represented educational institutions, transportation companies, individuals and commercial entities in construction, contract, employment, intellectual property, personal injury and toxic tort claims.

Mr. Hutchison practices in federal and state courts, before administrative and arbitration tribunals, and before mediators. He has tried over 50 cases to verdict or award.

Mr. Hutchison also counsels individuals, corporations, and institutional clients on risk management, contract, intellectual property and procurement issues.
