Tony Pane

Tony is a Special Counsel practising in the areas of domestic and international taxation. He has over 30 years’ experience advising on taxation matters in legal, accounting, and corporate environments.

Tony’s principal focus is corporate taxation including mergers and acquisitions, capital management, financing, and cross border structures/transactions. While most of his work involves structuring advice, he also represents clients in dealings with revenue authorities.

Tony has been a member of the Commissioner of Taxation’s General Anti-Avoidance Rule Panel since 2005.

Tony was also a member of the 2012 Treasury Roundtable advising government on announced amendments to the General Anti-Avoidance Rule. He is a 25 plus year member of The Tax Institute, and a member of the Monash University Postgraduate Studies Advisory Board – Commercial Law Specialisation.

Recent experience includes:

• Acting for Village Roadshow Limited in obtaining a Class Ruling from the Australian Taxation Office in late 2013 confirming the taxation treatment of a return of share capital to shareholders.

• Advising during 2013 on income recognition under the Australian Foreign Source Income Rules and the availability of tax losses.

• Advising during 2013 on the debt/equity classification of unusual financial arrangements and taxation implications of restructuring those arrangements.
