Representative Matters
- Served as co-defense counsel for neurosurgeon and neurosurgery clinic in which plaintiff alleged wrongful death as a result of alleged medical malpractice related to a complex neurosurgical procedure and delayed infection. Following a three-week trial in February 2013, the jury returned a defense verdict.
- Served as co-defense counsel for spice manufacturer in action brought by U.S. Food and Drug Administration (FDA) in which the FDA sought broad injunctive relief including destruction of inventory based on violations of the Food, Drug and Cosmetic Act. In a published ruling, the U.S. District Court for the Western District of Tennessee recognized the extensive measures undertaken by the manufacturer to ensure compliance with FDA rules and regulations and that the relief sought by the government was largely unnecessary. The court refused to order much of the relief requested by the FDA.
- Represented owner of Durable Medical Equipment supplier in federal criminal case in which the client admittedly submitted forged prescriptions and fraudulent claims for power wheelchairs valued at approximately $400,000 and received a sentence of home confinement, probation and restitution.
- Represented large medical center in DOJ investigation of qui tam complaint alleging False Claims Act violations. Government declined to intervene and dismissed the underlying Complaint.
