Stuart I. Gordon is a partner in Rivkin Radler LLP’s Bankruptcy Practice Group and focuses his practice on bankruptcy, corporate reorganization, and related litigation matters. Based in Uniondale, New York, he represents a diverse range of clients, including financial institutions, insurance companies, real estate owners and developers, retailers, manufacturers, distributors, restaurants, physicians and medical practices, non-profit organizations, unions, and health and welfare funds.
Stuart handles litigation arising under the Bankruptcy Code and regularly appears in bankruptcy courts nationwide. His work includes contested matters involving motions for relief from the automatic stay, avoidance actions, breach of fiduciary duty claims, and disputes concerning property rights. He also prosecutes and defends matters involving preferences, fraudulent conveyances, the assumption or rejection of executory contracts, and issues related to the dischargeability of debt.
His practice encompasses all aspects of Bankruptcy and Creditor Debtor Rights / Insolvency and Reorganization Law. Stuart represents debtors, secured and unsecured creditors, creditors’ committees, purchasers of distressed debt and assets, plan proponents, landlords, equipment lessors, and equity holders in complex bankruptcy and restructuring matters. His experience includes both Chapter 7 and Chapter 11 proceedings, as well as related Litigation - Bankruptcy matters.
In addition, Stuart represents insurance carriers in bankruptcy cases involving competing claims to insurance proceeds. He assists insurers in navigating complex insolvency proceedings and works to protect their contractual and statutory rights, including the incorporation of insurance neutrality provisions and related protections in plans of reorganization and court-approved agreements.
