Biography

Steven T. Henesy is a partner in Rivkin Radler LLP’s Compliance, Investigations & White Collar; Critical Incident Response; and Insurance Fraud Practice Groups, based in the firm’s Uniondale, New York office. His practice focuses on Corporate Governance and Compliance Law and Insurance Law, with an emphasis on complex litigation, regulatory issues, and fraud-related matters.

An experienced litigator, Steve represents major insurance carriers in civil actions under the federal Racketeer Influenced and Corrupt Organizations (RICO) Act, including affirmative lawsuits to recover fraudulently obtained insurance benefits and actions seeking injunctive relief to stop ongoing fraudulent schemes. He also advises insurers and corporate clients on compliance programs, internal investigations, fraud prevention strategies, and risk management considerations.

Admitted to practice in New York, Florida, and Michigan, Steve regularly represents clients in state and federal courts across the country, including matters venued in Arizona, California, Florida, New Jersey, New York, and Oregon. His national litigation experience allows him to address multi-jurisdictional insurance and compliance issues efficiently and strategically.

Steve began his legal career as an assistant district attorney in the Nassau County District Attorney’s Office, where he served as lead counsel in numerous jury trials. His background as a prosecutor informs his approach to litigation, investigations, and advising clients facing potential civil and criminal exposure.

Drawing on his combined prosecutorial and private practice experience, Steve provides practical guidance on the intersection of civil litigation, regulatory compliance, and criminal law, including issues involving Fifth Amendment considerations. He is also a published author, and his article, “NY Law Remains Unclear on Non-Party 5th Amendment Invocations and Negative Inferences,” appeared in the New York Law Journal.
