As a partner with Cornell Smith Mierl & Brutocao, LLP, Steven L. Mierl represents employers from across the country on a wide range of employment management and litigation issues. These include hiring and termination, dispute resolution, partnership and corporate management disputes, buyouts, conflicts, internal investigations, contract and document drafting, and administrative proceedings. He also represents executives on non-competes, compensation and other contract matters. Throughout his career, Mr. Mierl has worked with numerous employers before the Equal Employment Opportunity Commission, the Department of Labor, the Texas Workforce Commission, and the Occupational Safety and Health Administration, and is familiar with each agency’s policies and practices. In addition to representing clients in more than 100 combined mediations, arbitrations, and bench and jury trials, Mr. Mierl is an experienced public speaker with more than 150 public engagements, covering all aspects of management-side employment issues.
Mr. Mierl has extensive experience enforcing and defending non-compete and non-solicitation matters. Specific successes, both inside and outside the courtroom, include helping to defend against a multi-million dollar verdict in a federal jury trial stemming from a Title VII/ADA employment discrimination case, winning an award in the mid-six figures in an executive contract arbitration in Texas, summary judgment for an employer in a seven-figure FLSA class action lawsuit that was upheld by the Fifth Circuit Court of Appeals, summary judgment in favor of the defense in an ADA matter, a defense verdict in a federal trial in a Phoenix, Arizona trial involving race and age claims, and summary judgment in a multi-million dollar proposed class action involving a federal Fair Credit Reporting Act employment background check violation.
Before beginning his practice, Mr. Mierl worked in commercial insurance in the United States and Caribbean. He’s recognized as an expert on employment practices liability insurance, and is frequently asked to speak on the matter.
Mr. Mierl’s law practice began in the United States Virgin Islands at Briggs, Knoepfel and Ronca. He then moved home to Austin, Texas, spending over seven years with Haynes and Boone. He helped co-found the law firm of Cornell Smith Mierl & Brutocao in 2003.
