Stephen specialises in large and complex commercial disputes, and has extensive experience in managing large disputes which require a team-based approach across different jurisdictions. He liaises closely with his clients to achieve the most favourable and cost efficient outcome possible.

Stephen’s litigation practice focuses on general corporate and commercial litigation in respect of a wide variety of contractual matters, including Competition and Consumer Act and Corporations law advice and litigation, product liability advice, banking and finance disputes – including security enforcement and recovery of debts owed to lending institutions.

Stephen is a member of the National Product Liability Association of Australia, and is a committee member of the Competition and Consumer Committee, and Business Law Section of the Law Council of Australia.

Stephen is also the principal liaison partner acting for the Australia Competition and Consumer Commission (ACCC) in a number of prosecutions over an 8 year period. He advises regularly on all Competition and Consumer Act matters including informal clearances relating to mergers and acquisitions.

Recent experience includes:

  • Advising Mitsubishi Motors Australia Ltd generally for more than 20 years’ as principal liaison partner, and as a member of its Corporate Compliance Committee and Safety and Recall Committee (reporting to the Board of Directors), in respect of all commercial, corporate, product liability, franchise litigation, and competition matters.
  • Advising Acciona Agua Australia Pty Ltd and Acciona Agua Adelaide Pty Ltd in respect of matters arising from the design, construction, and commissioning of the A$1.83 billion Adelaide Desalination Plant at Port Stanvac, South Australia.
  • Acting for a client in Supreme Court of Queensland proceedings brought by Vision Group Holdings Ltd and its subsidiary, Icon Laser (Aust) Pty Ltd, seeking approximately A$26 million in damages and an injunction restraining our client from breaching restraint of trade provisions in two agreements.
  • Advising a major Australian bank in relation to a large business audit by the Australian Taxation Office (ATO), in respect of its potential liability, developed detailed responses to position papers issued by the ATO, and successfully negotiated a resolution on terms favourable to our client without the necessity of proceeding to litigation.
