Case History

Cases
  • Client Has Suffered Serious Injuries After Collision in Prince William County
On November 8, 2024, our client sustained catastrophic injuries in a motor vehicle collision in Prince William County, Virginia. A driver insured by USAA failed to yield while making a left turn and struck our client’s vehicle. As a result of the collision, our client suffered extensive traumatic injuries, including fractures to both femurs, patellae, tibia, ankle, and ribs, as well as a collapsed lung. Her treatment involved multiple surgeries, prolonged hospitalization, and an extended period of inpatient rehabilitation. Based on the established liability and the profound, permanent impact of the injuries on our client’s daily life and independence, Portner & Shure pursued the claim and recovered the available policy limits of $1.3 million.

  • Pedestrian Accident Due to Negligent Driver
Northern Virginia personal injury attorney resolves pedestrian accident case for $2.15 million. Our client, a mother, wife, and valued member of her community, lost her life after being struck by a vehicle operated by a negligent driver. The injuries she sustained ultimately proved fatal. At the time of the incident, our client was lawfully walking her three dogs within a marked crosswalk when the collision occurred. Law enforcement cited the driver, who was later found guilty in traffic court for failing to maintain proper attention.
On behalf of our client’s family, we filed a civil action seeking accountability through claims of negligence, wrongful death, and survival. The lawsuit detailed the driver’s failure to yield to a pedestrian and to remain attentive to surrounding conditions, conduct that resulted in devastating loss for the family.
After the case was filed, defense counsel asserted that our client was contributorily negligent or, alternatively, that the incident was unavoidable due to sun glare. These defenses were pursued despite the absence of eyewitness testimony.
Following two mediations and extensive negotiations, the matter was resolved prior to trial with a settlement in the amount of $2.15 million.

Maryland medical malpractice matter resolved for $2.6 million involving a birth injury. The case concerned an infant born at a Maryland hospital who sustained injuries during labor and delivery. Evidence showed that a rupture of the mother’s placenta occurred while she was hospitalized and that appropriate monitoring was not provided. As a result, the infant experienced a loss of oxygen to the brain prior to delivery the following morning. The child was born with brain damage and later diagnosed with cerebral palsy.
