Seth E. Dizard is a Milwaukee, Wisconsin attorney withO’Neil, Cannon, Hollman, DeJong & Laing SC. He serves as chair of the firm’s Banking, Receivership, and Creditors’ RightsPractice Group and regularly serves as a court-appointed receiver throughout Wisconsin. His receivership work involves businesses, construction projects, real estate developments, marital and family estates, rental income properties, and individuals with substantial assets.
Seth represents financial institutions, secured and unsecured corporate and individual creditors, companies acquiring distressed businesses, and financially troubled corporations in state and federal courts. He also assists business owners with informal financial workouts, refinancing, and other strategies involving financial distress. His work includes serving as and representing court-appointed receivers in assignments for the benefit of creditors, including Chapter 128 receiverships, real estate foreclosures, the winding up of closely held corporations, and complex post-judgment collection matters.
As a fiduciary, Seth regularly serves as successor trustee when disputes arise during trust administration. In this role, he works to achieve an equitable division of property in mixed-asset trusts when liquidation could reduce value. He also traces commingled trust assets; investigates, preserves, and recovers assets following the diversion of funds; and manages litigation on behalf of trusts for the benefit of beneficiaries when a trustee has breached fiduciary duties. Seth also develops, negotiates, and implements disposition strategies involving trust assets.
Since joining O’Neil, Cannon, Hollman, DeJong & Laing SC in 2007, Seth has managed and transitioned more than $100 million in assets. He assists clients with the acquisition and disposition of businesses and business assets in insolvency proceedings and represents secured and unsecured creditors in bankruptcy proceedings across the country.
