Q&A

The law firm of Miller Legal Partners PLLC won a bench trial in a patent infringement case on behalf of its client PHC Fluid Power, LLC in the case of Total Rebuild, Inc. v. PHC Fluid Power, LLC in the United States District Court for the Western District of Louisiana. The trial team, comprised of lead trial counsel Sam Miller and co-counsel Nick Valenti, Sara Ellis, and Hayley Baker obtained a judgment that the patent-at-issue was unenforceable due to inequitable conduct, because the inventor withheld material information of prior sales from the Patent Office with the specific intent to deceive the Patent Office into granting the patent. The Court dismissed with prejudice all claims against PHC Fluid Power, LLC. The trial victory was the culmination of four years of litigation with discovery and depositions throughout the United States. “This is significant and meaningful victory for our client who has had to deal with being publicly accused of infringement for the last four years,” said Sam Miller. “I am proud of the grit shown by our attorneys throughout the course of this case.”
