Transactions
  • EEOC v. Jefferson Dental Clinics
478 F.3d 690 (5th Cir. 2007). Four former employees sued Jefferson Dental Clinics in state court. After JDC won a complete defense verdict, the EEOC pursued its own lawsuit in federal court on the same facts. The Fifth Circuit ruled the judgment in the state court case barred the EEOC from seeking any individualized relief on behalf of the individuals, even though the EEOC had not been a party to the state court case. This is important to employers who otherwise could have faced two lawsuits over the same facts.
