Biography

Roberto Tomassini is a partner, and the Department Head of the Koskie Minsky’s Pension and Employee Benefits and Tax Group. He has specialized expertise in all areas of pension and benefits law as well as the taxation and tax compliance relating to pension, employee benefit plans, training funds and various non-profit organizations. Roberto has extensive experience advising sponsors and trustees of health and welfare trusts and employee life and health trusts (ELHTs).

Roberto has proficiency in all matters relating to income, provincial sales, and premium tax issues affecting the design and administration of pension and employee benefit plans, and various non-profit organizations. He has represented clients in proceeding before the Tax Court of Canada and advises and represents clients with Canada Revue Agency appeals and securing advanced tax rulings and technical interpretations to support client initiatives and operations. He also aids and provides representation with voluntary disclosure applications with both federal and provincial regulators across Canada, to assist client with compliance and securing relief from penalties and interest for non-compliance.

His pension and benefits law experience spans a broad scope of benefit plan and non-profit organizations, including registered and unregistered pension funds, foreign pension plans, health and welfare trusts, employee benefit plans, employee trusts, training trust funds, self-funded leave plans, supplementary unemployment benefit plans, fraternal benefit societies, industry stabilization funds and registered charities.

Roberto has written extensively in the area of pension and employee benefits. He is a primary editor and contributor to Employee Benefits in Canada (Fourth Edition, published by the International Foundation of Employee Benefit Plans, which is used as a primary resource by several Canadian educational institutions. He serves on the advisory board for the Canada Department of Finance advising on legislative developments and policy relating to the taxation and regulation of employee benefit plans.
