Robert M. Einhorn is a Partner at Zarco Einhorn Salkowski, P.A., a nationally recognized Miami-based law firm focused on Franchise Law, Business Trial Law, and Complex Commercial Litigation. For more than three decades, he has represented franchisees, multi-unit operators, franchisee associations, dealers, distributors, licensees, and business owners in significant franchise and commercial disputes throughout the United States.
Mr. Einhorn has devoted much of his career to representing franchisees in sophisticated litigation, arbitration, mediation, and other business disputes involving hundreds of franchise systems. His experience spans the hotel, restaurant, retail, automotive, and service industries and includes matters involving wrongful termination, encroachment, fraud, contractual disputes, business torts, and other conflicts affecting franchise relationships and business operations.
An attorney and accountant, Mr. Einhorn combines extensive litigation experience with a strong financial and business background. He earned his Bachelor of Business Administration from the University of Wisconsin-Madison, where he dual-majored in Accounting and Risk & Insurance, and his Juris Doctor from the University of Miami School of Law. This multidisciplinary background provides him with particular insight into the financial, operational, and strategic issues that frequently drive complex franchise and commercial disputes.
Mr. Einhorn joined Robert Zarco in 1994 and has played an important role in building Zarco Einhorn Salkowski, P.A.'s nationally recognized franchise litigation practice. He also works extensively with franchisee associations and has long advocated for fair franchising practices and more balanced relationships between franchisors and franchisees.
His involvement in the franchise legal profession extends well beyond his client practice. Mr. Einhorn has been an active participant in the American Bar Association Forum on Franchising and the American Association of Franchisees and Dealers (AAFD). He has served on the AAFD's Fair Franchising Standards Committee, frequently speaks at the ABA Forum on Franchising's Annual Meeting, and is serving as co-chair of the ABA Forum on Franchising's 2026 Annual Meeting in Toronto.
Mr. Einhorn has also made significant contributions to franchise law scholarship. He was a contributing author to the ABA's Fundamentals of Franchising, Fourth Edition, Co-Editor of the Franchise Litigation Handbook, Second Edition, and co-author of "Personal Liability for Franchise Sellers," published in the Franchise Law Journal in 2024. He has additionally served as both an author and editor of the Franchise Law Journal.
Mr. Einhorn has received numerous professional distinctions for his work in Franchise Law and Commercial Litigation. He has been recognized in The Best Lawyers in America® and was named Best Lawyers® "Lawyer of the Year" for Franchise Law in Miami in both 2012 and 2017. He is ranked by Chambers USA in Franchising and received the American Association of Franchisees and Dealers' Lifetime Achievement Award in Total Quality Franchising in 2025. His additional distinctions include induction into the Franchise Times Legal Eagles Hall of Fame, recognition among the Very Best U.S. Attorneys, a Top 50 Bench Award in the United States in 2023, and Martindale-Hubbell's AV Preeminent® Peer Review Rating.
Mr. Einhorn also contributes his time to pro bono service in South Florida. Through the Dade County Put Something Back Pro Bono Project, he regularly serves as a Guardian ad Litem, assisting underserved individuals and families in Miami-Dade County.
