In an era when very few cases are decided in a courtroom, Robert takes pride in trying cases to a jury whenever and wherever defendants are unwilling to accept full responsibility for their wrongdoing. Robert’s skill and tenacity have been widely noted.

He is board-certified as a Civil Trial Specialist by the American Board of Trial Advocacy. He has also been elected to the American Board of Trial Advocates (ABOTA).   • $40 million jury verdict in defective seatbelt case;
  • $35 million jury verdict for wrongful death caused by medical negligence at Springhill Medical Center;
  • $14.8 million jury verdict for wrongful death and personal injury in a natural gas explosion in one of the most conservative venues in the United States;
  • $6.5 million jury verdict in auto collision crash;
  • $3 million jury verdict for personal injuries suffered in a crash with a tanker rig;
  • $2 million jury verdict for sheriff’s deputy hit by 18-wheeler;
  • $1.78 million jury verdict for personal injuries suffered in a fall at a national chain restaurant;
  • $1.725 million jury verdict for personal injuries suffered in a fall at a retail facility;
  • $1.7 million jury verdict for personal injuries suffered in an industrial site accident.

By aggressively preparing cases for trial, Robert has also obtained numerous multi-million dollar settlements for his clients. These cases involve everything from 18-wheeler crashes to defective consumer products to industrial site injuries.

Away from the office, Robert and his wife take great pleasure in raising their three children. Robert has also served on the Board of Directors for Via, a charitable organization dedicated to supporting senior citizens in need, on the Senior Bowl Charitable Committee, and most recently on the Board of Ambassadors for the American Cancer Society. When not practicing law or spending time with his family, Robert enjoys exploring the Mobile River Delta.

  • Leytham v. Kia Motors of America | Mobile County, Alabama Circuit Court | Case No. CV-2006-002263
The attorneys of Cunningham Bounds achieved a $40 million dollar wrongful death verdict against Kia Motors of America, Inc., Kia Motors Corporation, and DBI/Celltrion. The case involved the A97 seatbelt buckle in model years 1995 through 2000 Kia Sephia and Sportage vehicles. These buckles were found to have a safety defect that caused them to be susceptible to “false latching” so that users think they are properly belted when in reality they are not. In this case, a 16-year-old driver lost control of her 1999 Kia Sephia and it crashed. During the accident her seatbelt buckle failed, she was ejected from the vehicle and died from her injuries.

In this case, $14.8 million verdict was obtained for a family involved in a gas explosion in their home.
  • Hodgson v. JVR Trucking, LLC, et al. | Mobile County, Alabama | Case No. 02-CV-2012-902852
The morning that a week-long trial was set to begin, the attorneys of Cunningham Bounds finalized a $5 million settlement for the family of man who was crushed to death when two high-density polyethylene pipes, weighing nearly 1-ton, rolled off a flatbed trailer during the unloading process. The lawsuit alleged that Mr. Hodgson died because industry pipe-loading standards and the Federal Motor Carrier Safety Regulations were not followed.
  • Davis v. O’Charley’s, Inc.
Cunningham Bounds attorneys successfully proved that the management of the O’Charley’s Restaurant in Daphne, Alabama was aware of a hazardous area in the restaurant where numerous guests and employees slipped and injured themselves, but did nothing to correct the hazard. In its verdict, the jury awarded $1.5 million in punitive damages and $293,000 in compensatory damages to a local woman who suffered severe injuries to her hip and leg due to a fall at the restaurant.

In 2013, firm partners obtained a $1.7 million jury verdict for a client injured when the wire ropes in a manlift suddenly retracted, causing him to fall. The jury awarded $1 million in compensatory damages and $700,000 in punitive damages. Cunningham Bounds’ client was using a manlift to install an overhead crane at the ThyssenKrupp Plant in Calvert, Alabama. While he was in the basket of the manlift and nearly 80 feet in the air, the wire ropes in the manlift catastrophically failed. The wire rope failure caused the boom of the manlift to suddenly retract, causing him to fall nearly 20 feet. Suspended 60 feet in the air, injured, unable to move, and trapped in the manlift, it took rescue crews 45 minutes to get him safely to the ground.
