Biography

Rob Stone is a partner in Alston & Bird’s Health Care Group, whose practice focuses on health care compliance and regulatory matters, primarily counseling national health care systems, academic medical centers, physician groups and other health care providers. His skills include assisting with the broad range of federal and state fraud and abuse issues, from compliance program development and review to internal and government investigations. He has extensive experience preparing, negotiating and resolving provider self-disclosures under both the OIG and CMS protocols.

On the corporate side, Rob counsels clients who are entering or exiting joint ventures, facing complex reimbursement issues, engaging in physician recruitment, clinical trial contracting and related regulatory compliance. In addition to providers, he has also worked with medical device manufacturers, GPOs, medical supply companies and other companies in the health care industry.

Rob regularly presents at national seminars on complex and novel reimbursement matters as well as fraud and abuse and compliance issues.

Before law school, Rob practiced as a mental health counselor in Florida, working in the juvenile justice and community mental health systems.

  • Medicaid Managed Care Management Organizations Act
Rob was one of the primary drafters of Georgia’s first statute to regulate Medicaid managed care organizations in the state on behalf of the Georgia Hospital Association.
  • United States ex rel. Phillip Schaengold v. Memorial Health, Inc., et al.
Rob served as the lead regulatory attorney on the defense team representing Memorial Health (Savannah) against a qui tam lawsuit involving allegations related to physician arrangements. This was the first False Claims Act case in the country to be filed by the former president and CEO of a health system defendant.
Transactions
  • Multiple Bundled Payment Program Representations
Rob has represented providers and other entities involved in cutting edge bundled payment programs for almost 10 years. He represented 2 of the 5 hospitals selected for participation in the Acute Care Episode (ACE) demonstration, one of Medicare’s first bundled payment programs.
More recently, Rob has represented multiple hospitals, conveners and vendors involved in the Bundled Payment for Care Improvement Initiative, a more expansive alternative payment methodology that continues to grow through programs such as the Comprehensive Care for Joint Replacement (CJR) and Episode Payment Model (EPM). Bundled payment programs seek to align interests across acute, post-acute and physician providers and incentivize high quality, efficient care.
