Biography
A native of Southern California, attorney Randy Walton represents clients in counties throughout the region. His practice, based in North County San Diego, focuses on a range of personal injury and wrongful death cases, including those arising from motor vehicle accidents, work and property injuries, and brain trauma. Mr. Walton firmly believes that individuals harmed by the carelessness of others deserve justice, regardless of the case's size or the severity of the injury. This conviction has driven him to recover millions of dollars for personal injury victims and their families.
In addition to his personal injury work, Mr. Walton dedicates a portion of his practice to holding care facilities accountable for the physical abuse and neglect of elderly and dependent adults. He prosecutes cases against nursing homes, assisted living centers, and home health agencies, addressing the growing issue of elder abuse. To support his advocacy, he is a member of the Consumer Attorneys of both San Diego and California, as well as the National Consumer Voice for Quality Long-Term Care.
Mr. Walton is also a certified mediator with the National Conflict Resolution Center. He demonstrates a strong commitment to his community, having served four years on the San Marcos City Council and ten years on the San Marcos Unified School District's Governing Board. He co-founded Project Next, a non-profit helping high schoolers plan for college or careers, and is a graduate of Leadership North County. An avid surfer, he coached the San Marcos High surf team to three state titles and enjoys hiking and spending time with his family.
Mr. Walton's professional excellence is widely recognized by his peers. He holds an AV Preeminent rating from Martindale-Hubbell for his high-level legal ability and ethics. For 12 consecutive years (2014-2025), he was selected for inclusion in Super Lawyers magazine and was most recently named to the 2025 and 2026 edition of Best Lawyers in America. How long will my case take?
This is another excellent question, and much like determining the case's value, the timeline can vary significantly from one case to another. While we always strive to resolve cases as efficiently as possible, our primary goal is to achieve the best possible outcome for you, not the fastest one. Rushing a case often means leaving money on the table.
- Your Medical Treatment: This is often the most significant factor. We cannot begin to negotiate a final settlement until you have either fully recovered from your injuries or reached what is known as 'Maximum Medical Improvement'. This is the point where your doctors have a clear understanding of your long-term prognosis and any future medical care you may need. Your health is the priority, and the legal timeline often follows your medical one.
- The Complexity of Your Case: A straightforward car accident with clear fault and minor injuries will typically resolve much faster than a complex case involving multiple defendants, severe injuries, or disputed liability.
- The Cooperation of the Insurance Company: Some insurers are reasonable and willing to negotiate a fair settlement in good faith. Others may use delay tactics, deny responsibility, or make unreasonably low offers. If we are dealing with an uncooperative insurance company, the process will take longer.
