Rachel C. Witcher

Rachel Witcher is a litigator with over a decade of experience representing financial institutions such as national banks, consumer mortgage lenders, commercial hard money lenders, loan servicers, credit unions, and foreclosure trustees in state and federal court. Rachel regularly defends litigation arising under the Fair Debt Collection Practices Act (FDCPA), the Fair Credit Reporting Act (FCRA), the Truth in Lending Act (TILA), the Real Estate Settlement Procedures Act (RESPA), and other state and federal consumer protection, licensing, and lending regulations. Outside of litigation, Rachel assists clients with due diligence in loan portfolio acquisitions, pre-litigation demands for repurchase, and strategy relating to foreclosure and REO holdings. Rachel also has experience representing clients in regulatory investigations initiated by California’s Department of Financial Protection and Innovation (DFPI) and similarly situated entities.

In addition to her robust background in creditors’ rights, Rachel also served as in-house counsel, where she gained experience representing employers in litigated matters, drafting company policies, training employees, and advising businesses on trending compliance issues.

Prior to joining Clyde Snow, Rachel managed a team of attorneys responsible for handling complex litigation, title curative actions, escrow disputes, contested tenant evictions, and other real estate-related matters across multiple jurisdictions.
