Phil Bousquet advises clients throughout New York on matters involving the Brownfield Cleanup Program (BCP), economic development incentives, and Corporate Law. Based in Syracuse, New York, Phil works with developers, municipalities, financial institutions, brokers, consultants, and business owners on projects and transactions across the state.
For many years, Phil has helped clients understand how New York’s Brownfield Cleanup Program affects redevelopment projects and related tax incentives. He has worked with developers and stakeholders on projects located in Manhattan, Brooklyn, Queens, the Bronx, Yonkers, White Plains, Long Island, the Catskills, the upper Hudson Valley, and upstate communities including Syracuse, Utica, Buffalo, Ithaca, Binghamton, and northern New York. Collectively, these redevelopment projects represent more than $5 billion in construction value and substantial Brownfield Cleanup Program tax credits.
Phil regularly assists clients with the preparation and documentation required to pursue Brownfield Cleanup Program tax credits and other economic development incentives. He works closely with accountants and financial professionals to prepare supporting materials and advises clients during audits and proceedings involving the New York State Department of Taxation and Finance, the Division of Tax Appeals, the Tax Appeals Tribunal, and New York courts.
In addition to his brownfield redevelopment and tax incentive work, Phil advises clients on a broad range of Corporate Law and commercial matters. His practice includes the purchase and sale of closely held businesses and professional practices, business formation, LLC operating agreements, shareholder agreements, buy-sell agreements, and day-to-day legal and operational matters affecting businesses across multiple industries.
Phil has also spoken on Brownfield Cleanup Program tax issues for organizations including the New York State Bar Association, the Business Council of New York State, New Partners for Community Revitalization, the Brownfield Coalition of the Northeast, the American Waste Management Association, local governments, and professional associations.
