Nicholas Zaita

A Partner in Peckar & Abramson PC’s New Jersey office, Nick focuses his practice on Construction Law and related business disputes on behalf of contractors and corporate clients. Based in River Edge, New Jersey, he advises clients throughout all phases of claims and litigation involving complex infrastructure projects, commercial development, and residential construction.

Nick regularly represents heavy-highway construction contractors, sitework and utility contractors, and specialty subcontractors in state and federal courts in New Jersey and New York. His work spans every stage of a dispute, including case evaluation, pleadings, discovery, motion practice, mediation, trial, and appeals. He has tried multiple matters to verdict or judgment and has achieved dismissals, judgments, and negotiated resolutions for clients. In addition, Nick advises clients on construction contracts, public procurement issues, and bid protests, and he serves as a guest lecturer at Columbia University’s College of Engineering on construction-related legal topics.

A substantial portion of Nick’s practice is devoted to serving as outside corporate counsel to construction companies and other businesses in the New York–New Jersey metropolitan area. He provides guidance on contract drafting and negotiation, employment policies, risk management, and insurance coverage issues. Nick works closely with business owners and in-house teams to identify legal and operational challenges and to develop practical, business-focused solutions.

Nick has been involved in several published decisions, including E.E. Cruz & Co., Inc. v. Axis Surplus Insurance Co., 87 N.Y.S.3d 173 (1st Dep’t 2018), and Ernest Bock & Sons-Dobco Pennsauken Joint Venture v. Township of Pennsauken and Terminal Construction Corp., 477 N.J. Super. 254 (App. Div. 2023), each addressing significant issues in construction and insurance law.

He regularly authors articles and presents seminars on Construction Law and industry developments. Nick has also been recognized by the legal and business communities as an NJBIZ “Leaders in Law” honoree, a New Jersey Law Journal New Jersey Legal Awards “Mentor” honoree, and for inclusion among Bergen County construction lawyers highlighted by Bergen Magazine.

Before pursuing a legal career, Nick earned degrees in Sports Management from the University of Tampa and the University of Florida. While attending New York Law School, he combined his interest in sports and law by working as a law clerk for the National Football League Management Council.

Following law school, Nick served as a law clerk to the Hon. Robert P. Contillo, P.Ch. (Ret.), in the Superior Court of New Jersey, Bergen Vicinage. That experience provided him with insight into court procedures and judicial decision-making, which informs his approach to litigation and client counseling.

Nick resides in Morris County with his wife and three children.
