When disputes related to estates and trusts arise, fiduciaries and beneficiaries turn to Neil Carbone. Neil has handled contentious estate and trust matters for more than two decades. He is known for his ability to narrow the issues in dispute and then find the most effective way to bring about a resolution, whether it be through litigation, mediation or negotiation. Neil's work with contentious matters make him well-equipped to assist clients in connection with the administration of trusts and estates and to handle complicated and sensitive estate planning where disputes may arise in the future. Neil's practice has been devoted exclusively in the area of trusts and estates since 1997. Neil's clients include trust companies, banks, foundations, other institutions, and individual fiduciaries and beneficiaries.With experience at both the trial and appellate levels, Neil has successfully represented clients in a wide variety of litigated estate and trust matters, including will and trust contests, contested fiduciary accountings and fiduciary surcharge and removal proceedings. Neil has also achieved favorable results for clients in discovery and turnover proceedings, proceedings involving claims against estates, construction and reformation proceedings, disputes related to the spousal right of election and other miscellaneous proceedings. Known among his peers as a strong, serious and seasoned advocate, Neil appears regularly before the Surrogate's Courts, other courts throughout New York and the United States Tax Court. In addition to handling litigated matters, Neil handles sophisticated estate planning and administration. His practice includes tax planning for high-net-worth individuals and families, preparation of wills and trust agreements, administration of estates and trusts, and representation of clients before federal and state taxing authorities. Neil currently serves as co-Chair of the Estate Litigation Committee of the Trust and Estates Section of the New York State Bar Association. Neil has lectured on numerous occasions, including for the New York State Bar Association and the New York Bankers' Association. Before entering private practice, Neil was a senior court attorney at the New York Court of Appeals, the highest court in the state of New York. While attending law school at night, Neil also served as an intern in the Surrogate's Court.
