Mitchell Fournie is a litigator with a focus on corporate and commercial disputes. He acts for both plaintiffs and defendants in a wide range of business disputes, including breach of contract claims, shareholder rights, professional negligence, fraud, defamation, investment loss, and insurance coverage litigation. Mitchell has represented clients in trials and appeals at all levels of court in Ontario, the trial courts of British Columbia, Saskatchewan, Newfoundland and Labrador, several administrative tribunals, and in private arbitrations.

Mitchell also has a specialized employment practice, where he represents businesses, professionals, and executives in wrongful dismissals claims, severance package negotiations, workplace investigations, and injunctions related to breach of non-solicitation and non-compete clauses.

In addition to his civil litigation practice, Mitchell is experienced representing individuals and companies facing investigation and enforcement proceedings before the Ontario Securities Commissions (now Capital Markets Tribunal), the Canadian Investment Regulatory Organization (CIRO, formerly, the Investment Industry Regulatory Organization of Canada and the Mutual Fund Dealers Association), as well as the Financial Services Regulatory Authority (FSRA). Mitchell’s experience with the rules and regulations governing the capital markets provides value to clients faced with complex investigations and compliance situations.

Prior to joining the firm in 2018, Mitchell articled at the Ontario Superior Court of Justice, where he clerked for the judges of the civil, class actions, and commercial list, as well as the family and criminal courts.
