Mark R. Filipp is a shareholder and director at Kemp Klein in Troy, Michigan. He has more than 30 years of litigation experience representing businesses and management in complex disputes. His practice includes Commercial Litigation, Employment Law - Management, and Litigation - Labor and Employment. Mr. Filipp regularly represents companies in employment-related litigation in state and federal courts throughout Michigan, as well as before administrative agencies such as the Equal Employment Opportunity Commission (EEOC) and the Michigan Department of Civil Rights (MDCR). He has also defended companies, directors, and officers in matters involving shareholder oppression, breach of fiduciary duty, and negligence.
Mr. Filipp represents employers in a wide range of workplace disputes, including claims involving wrongful discharge, discrimination, harassment, retaliation, defamation, and whistleblower allegations. He also assists businesses with the preparation and enforcement of employment agreements, non-competition agreements, confidentiality provisions, and trade secret protections. In addition, Mr. Filipp works with organizations on severance agreements and separation arrangements for both employers and employees. His counseling practice includes advising employers on workforce management issues such as reductions in force, employee discipline, and termination decisions, along with compliance guidance related to federal and state employment laws including COBRA, the ADA, FMLA, HIPAA, and wage and hour requirements under the FLSA and Michigan law.
In addition to his litigation and counseling work, Mr. Filipp regularly writes and speaks on employment law topics affecting businesses and management. He has co-authored the Employment Law Answer Book, a comprehensive publication addressing employment law issues, for more than 17 years. Mr. Filipp has also presented educational programs on workplace law and previously taught the “Employment Law Series” through Schoolcraft College Continuing Education Services. He frequently conducts in-house training sessions for employers on workplace policies, legal developments, and strategies aimed at reducing the risk of employment disputes.
