Biography
Mark DeGiacomo dedicates his practice to working as a Chapter 7 and Chapter 11 bankruptcy trustee while representing clients in bankruptcy cases and commercial litigation matters.
Since 1995, Mark has been a valued member of the five-member Boston trustee panel chosen by the Department of Justice to select bankruptcy trustees. He has served as a trustee in numerous cases, acting to operate, sell, and liquidate businesses as needed.
In his role as counsel to the bankruptcy estate, Mark brings his extensive experience to his private clients navigating the complexities of the bankruptcy system.
Beyond managing bankruptcy estates, Mark represents various trustees, Creditor Committees in Chapter 11 cases, business debtors in Chapters 7 and 11, and both secured and unsecured creditors in Chapters 7, 11, and 13. His representation extends to defendants in bankruptcy preference and/or fraudulent conveyance adversary proceedings as well as commercial landlords.
Mark has been involved in numerous litigations within the Massachusetts bankruptcy courts and has handled appeals in front of the U.S. District Court, the Bankruptcy Appellate Panel, the U.S. Court of Appeals for the First Circuit, and the United States Supreme Court.
His litigation background is comprehensive, covering various aspects of commercial litigation such as director and officer cases, attorney and accountant malpractice, and contract and construction disputes.
