Marcia Mills

Marcia Mills practices in the area of Procurement and Government Contracts, National Security, International Trade & Customs, and Technology, Media and Telecommunications and is a member of the Fasken Government Relations team.

For over 25 years, Marcia has worked in both the public and private sector as external and in-house counsel in defence, aerospace & security and information technology, including a decade with Public Services and Procurement Canada (PSPC), the central purchasing agent for federal departments and agencies. During her tenure at PSPC, she provided strategic and legal advice to Canada’s largest public sector buyer and for some of Canada’s largest defence and Major Crown procurements.

Marcia draws upon her in-depth understanding of these varied areas to provide practical and strategic advice with respect to evolving issues in the procurement, tendering, and government contracts context, providing particular expertise with respect national security, supply chain and contract security, national security exceptions under trade agreements, the Defence Production Act, and the controlled goods program and regulations.

Whether her clients are suppliers or buyers, private or public sector, subject or not subject to Canada’s trade agreements, Marcia understands their perspectives and issues, providing relevant and useful legal and strategic advice throughout the entire procurement cycle - from early engagement/requirements definition, to solicitation drafting and bid preparation, bid evaluation, contract award and negotiation, contract management and bid disputes.

As a frequent speaker and writer on procurement and government contracts issues, Marcia has recently released the Fasken Guide for Government Contracts, Procurement and Tender Law in Canada - offering a precise and practical overview of the procurement and tendering process in Canada.
