Biography
Marc Leibman is an experienced litigator with an extensive background in New Jersey Municipal Land Use Law (MLUL), real estate tax appeals, federal criminal law, New Jersey state criminal law and commercial litigation. For over fifteen years, commencing in 2004, Mr. Leibman was appointed by the United States District Court of New Jersey to represent criminal defendants in Federal Court on serious federal offenses. He has tried cases in federal court, including a 17-week RICO case. Mr. Leibman has also served as a municipal prosecutor for the Borough of Leonia and has defended clients in federal courts in New Jersey, New York, Puerto Rico, Texas, North Carolina and Virginia.
Since 2001, Mr. Leibman has devoted a considerable amount of his practice to land use and zoning matters. Mr. Leibman serves or has served as Board Attorney to zoning and planning boards in Palisades Park, Hoboken, New Milford, Paramus, Fair Lawn, Dumont, River Vale and Woodcliff Lake. Mr. Leibman also represents individual and corporate clients before various zoning and planning boards statewide with a focus on northern New Jersey. He has litigated land use matters of all varieties, including use variances, bulk standards, design waivers and affordable housing on both the development and municipal side. He has successfully invalidated municipal ordinances through litigation and even obtained an automatic approval through litigation. He has also successfully handled appeals to construction boards arising from New Jersey Administrative Code violations. He has litigated easement and adverse possession cases from inception through verdict. He has served as Borough Attorney in both New Milford and Dumont.
Mr. Leibman has experience in a wide range of commercial litigation matters. Mr. Leibman assists clients in substantial real estate tax appeals involving property assessed in the tens of millions of dollars. He has represented both municipalities and taxpayers in the county tax boards, the tax court and appellate court, and has achieved substantial success in this area. Mr. Leibman’s property tax practice includes industrial, pharmaceutical, hotel properties and other large commercial developments.
