Kevin Fanning is an experienced commercial litigator who represents companies in the manufacturing, technology, electronics, transportation, financial services and securities industries in their most complex disputes. He has extensive trial experience serving as lead counsel in jury and bench trials before state and federal courts nationwide, and regularly appears before AAA, ICDR, JAMS and FINRA panels in arbitrations throughout the United States and internationally.
Kevin is known for his strategic approach to resolving high-stakes business disputes, his extensive courtroom experience, and his ability to proactively manage litigation risk for clients. Kevin routinely represents CMBS trusts, portfolio lenders, special servicers, and other interested parties in complex commercial, industrial, office and retail property loan enforcement, receiverships, foreclosures, and strategic workout matters. In addition, Kevin advises clients on emerging legal issues involving unmanned aerial systems (UAS/drone law), accessibility litigation under the ADA, FHA and WCAG, and healthcare-related disputes and investigations. Kevin also handles all aspects of litigation for various transportation and logistics companies involving the defense of serious accidents, freight claims, employment matters, insurance and indemnity issues, and related litigation. He also assists these companies to proactively hedge litigation risks through contractual and other means.
