Biography

Joe Faucher represents clients in Employee Benefits (ERISA) Law and Litigation - ERISA matters from Trucker Huss APC in Los Angeles, California. For more than 30 years, he has handled ERISA litigation and other employee benefit-related disputes involving retirement plans, disability insurance plans, health insurance plans, and life insurance plans.

Joe’s ERISA litigation practice includes defending class actions alleging breaches of fiduciary duty against retirement plan sponsors and fiduciaries, including matters involving claims of excessive fees and imprudent investment offerings. He has represented plans and fiduciaries in a wide range of benefits claims and fiduciary litigation matters in federal courts across the country.

He also represents independent employee stock ownership plan (ESOP) trustees in litigation brought by the U.S. Department of Labor and private plaintiffs, and counsels ESOP fiduciaries during Department of Labor investigations involving ESOP transactions. In a significant ESOP litigation matter brought by the Department of Labor, Joe helped achieve a settlement on the eve of trial for substantially less than the plaintiff’s original demand.

In addition, Joe has represented employee benefit plan service providers, including third-party administrators, actuaries, registered investment advisers, and insurance carriers. Alongside his litigation practice, he advises clients on risk management, insurance coverage, and compliance with Department of Labor regulations affecting employee benefit plans. He also assists service providers with drafting and negotiating service agreements for use with their clients.

Before joining Trucker Huss APC, Joe served as the senior West Coast ERISA litigator at a national law firm. Earlier in his career, he was a partner at a Southern California law firm where he concentrated on ERISA and employee benefits litigation matters. He has been recognized as a Southern California “Super Lawyer” in employee benefits law for multiple years.

Joe is admitted to practice in California, the Supreme Court of the United States, the U.S. Courts of Appeals for the Fourth, Seventh, and Ninth Circuits, all California U.S. District Courts, and the U.S. District Court for the District of Colorado. He has extensive experience arguing matters before the Ninth Circuit Court of Appeals.

A frequent speaker on ERISA and employee benefits litigation topics, Joe has authored articles and white papers addressing issues affecting benefit plan sponsors, fiduciaries, and service providers.

Joe has also completed the “Mediating the Litigated Case” program offered by the Straus Institute for Dispute Resolution at Pepperdine Caruso School of Law. His experience as an advocate in dozens of mediations informs his practical approach to resolving complex disputes.

In 2024, Joe was inducted as a Fellow of the American College of Employee Benefits Counsel, a professional organization recognizing attorneys who have made substantial contributions to the field of employee benefits law.
