Biography
John K. Diviney represents management-side clients in a wide range of labor and employment matters, including labor arbitrations and grievances, unfair labor practice charges, employment discrimination, harassment, and retaliation claims, wrongful competition and restrictive covenant disputes, and wage and hour collective and class actions.
John is a partner in Rivkin Radler LLP’s Employment and Labor Practice Group in Uniondale, New York. His practice focuses on Employment Law – Management, Labor Law – Management, and Litigation – Labor and Employment. He regularly appears before federal and state regulatory agencies such as the National Labor Relations Board, the Equal Employment Opportunity Commission, state and federal labor departments, and various fair employment practices agencies.
John has served as lead negotiator in collective bargaining matters involving major unions across the country. His experience includes negotiations and dispute resolution in the transportation, defense, manufacturing, and service industries, as well as matters involving public sector employers. He also represents employers in contract grievances and labor arbitrations.
In addition, John advises employers on day-to-day labor and employment compliance under state and federal laws, including the Family and Medical Leave Act and the Americans with Disabilities Act. His counseling work includes wage and hour issues, workplace policies, and the review of layoffs, disciplinary actions, and termination decisions.
