Biography

Jim Holloway is a recognized and ranked leader in the areas of intellectual property and technology, a skilled and experienced trial and appellate advocate, and a trusted strategic advisor. Jim was formerly the Managing Partner of the Toronto Office, a member of the Firm's Global Executive Committee, a member of the Firm's Policy Committee, and served as Chair of the North America region.

Practice Focus

Jim’s practice is focused on intellectual property law and technology, including trademark, copyright, patent and trade secret disputes. Jim also provides clients with strategic, pragmatic and commercial advice on the development, protection, monetization and enforcement of their intellectual property assets, and how to avoid/manage risk. He also handles anti-counterfeiting litigation, diversion and grey market matters, unfair competition claims, marketing and advertising complaints, licensing and distributorship disputes, breach of confidentiality matters, and product liability claims involving technology. Jim has advised and represented many leading companies in the intellectual property area, and has acted as lead counsel on matters before the Ontario Superior Court of Justice, the Ontario Court of Appeal, the Federal Court, Trial Division, the Federal Court of Appeal and the Supreme Court of Canada.

My practice is focused largely on intellectual property disputes, licensing and distributorship disputes, trade-secret and confidentiality matters, and on other technology and product-related litigation. I advise clients on how to spot problems, how to avoid problems, and how to fix the ones they encounter, including via the court process. I also advise clients on IP issues that might arise from their innovation, with a focus on online and social media content.

Every client has different priorities and thus different questions, but a common one is around the court process, e.g. how long is this going to take and how much will it cost? I respond by always providing detailed case budgets for every stage of a case, and help by deploying technology to achieve efficiencies in my matters and by always looking for ways to resolve cases early, either via negotiation, commercial agreements, ADR mechanisms and motions for the early determination of disputes before the court. Given the time and money that litigation involves, I think it's key to look for more efficient outcomes every step of the way.

We represented a large national retail company in a well-publicized copyright infringement case brought by a specialty TV provider involving emerging streaming technology. Together with counsel for our co-defendants, we were able to achieve an excellent result (i.e. the dismissal of the case) after prevailing on a lengthy and complex 5-day injunction hearing. The case was particularly interesting as it dealt with new issues and the need to distinguish some earlier cases based on the evidence and the technology involved. There was a great deal of investigative and expert evidence, too. Like many IP cases, it was multi-layered and required all of the lawyers involved to develop new ideas and arguments, often relying on older court decisions rendered well before this technology was launched.

One of the most challenging and interesting areas about IP law is that we're always trying to catch up with and understand innovation, while assessing and arguing how old law applies to new facts.

I've always been interested in the power of brands, and in technology and innovation, as well as in advocacy.
