Biography

Jeremy's practice spans work with a range of government and corporate clients. He has acted in claims before the High Court, Federal Court, various Supreme Courts and the Administrative Appeals Tribunal.

Jeremy's administrative and regulatory law experience includes:

  • advising Commonwealth agencies in relation to regulatory proceedings, including in relation to options and evidence required for declaratory, civil penalty and injunctive relief in accordance with the Regulatory Powers (Standard Provisions) Act 2014 (Cth)
  • representing a Commonwealth regulator in a Federal Court challenge to a legislative instrument on grounds the instrument was unreasonable, irrational and not reasonably proportionate to the relevant risks
  • acting for a Commonwealth regulator in an interlocutory application to stay the operation of an urgent legislative instrument to restrict news reporting during civil unrest
  • advising a range of Commonwealth agencies in appeals of administrative decisions before the Administrative Review Tribunal and Federal Court of Australia
  • advising a Commonwealth agency in relation to policies and procedures for executing search and seizure warrants, including for managing and resolving claims for Legal Professional Privilege
  • working with a Commonwealth regulator to manage statutory obligations to prepare a surge of determinations within prescribed timeframes. In managing this project, Jeremy worked with technology and project management teams to standardise and optimise systems for preparing the determinations.

Jeremy's dispute resolution and litigation experience includes:

  • acting for a range of Commonwealth agencies in civil proceedings in Federal and State Courts, typically involving novel duties of care. In these proceedings, Jeremy outlined strategies for the investigation and defence of proceedings, commissioned expert evidence and coordinated preparations for hearing
  • acting in proceedings involving allegations of loss caused by the use of, and exposure to, a range of toxic substances, including asbestos, silica, lead dust, coal dust and mould. In these proceedings, Jeremy managed and prosecuted complex cross-claims involving manufacturers, employers, occupiers and other relevant tortfeasors
  • managing multi-party proportionate liability disputes concerning property and business losses caused by fire
  • managing a portfolio of public liability claims for an international mining organisation with a presence across Australia. These proceedings involved catastrophic injuries and complex arguments in relation to the attribution and apportionment of liability, as well as in relation to issues of quantum
  • acting in professional liability proceedings against legal practitioners, medical practitioners, architects, agronomists, accountants and financial advisers
  • acting in a range of coronial inquests, including involving deaths caused by the prescription of opiate medications and the misdiagnosis of malignant conditions
  • appearing on behalf of medical practitioners in proceedings before Supreme Courts and administrative tribunals concerning disciplinary action and civil claims for relief.
