Jennifer A. Simon represents clients in Environmental Law and Litigation - Environmental matters from the firm’s Atlanta, Georgia office at Kazmarek Mowrey Cloud Laseter LLP. Her practice includes environmental, energy, toxic tort, and product liability matters involving litigation, regulatory proceedings, compliance counseling, and risk management.
Jennifer’s litigation work focuses on disputes involving wastewater, stormwater, contaminated groundwater, and storage gas migration across property boundaries. She represents clients in matters arising under CERCLA, the Clean Water Act (CWA), and related state environmental statutes, as well as claims involving nuisance, trespass, negligence, and other common law theories. She also defends companies in state and federal regulatory enforcement actions, cost recovery actions, and toxic tort and product liability litigation, including multidistrict and mass tort proceedings involving PFAS.
In addition to litigation, Jennifer advises companies nationwide on environmental investigation and remediation projects, including matters involving large multi-party Superfund sites. Her work includes permitting, regulatory compliance, allocation issues, contracting, and coordination with government agencies. She has significant experience with remediation projects involving former manufactured gas plant properties.
Jennifer regularly represents clients participating in federal and state rulemaking proceedings and administrative challenges involving environmental and energy regulations. Her experience includes matters involving greenhouse gas regulations under the Clean Air Act, PFAS legislation and regulatory developments, Waters of the United States (WOTUS) issues under the Clean Water Act, National Priorities List (NPL) listings, OSHA regulations, state water quality standards, MACT rules, and Endangered Species Act (ESA) determinations. She also maintains an active appellate and constitutional litigation practice and has prepared amicus briefs on behalf of companies, coalitions, and public interest organizations.
Jennifer further counsels businesses on environmental compliance and operational risk management, including issues related to PFAS reporting obligations, product restrictions, permitting, and environmental health and safety requirements. Her practice includes advising clients on compliance matters involving CERCLA, RCRA, the Clean Air Act (CAA), Title V permitting, NEPA, TSCA, EPCRA, and related federal and state environmental regulations. She also assists companies with voluntary disclosure matters and strategies related to penalty mitigation.
