Biography
Jason B. Castle has over two decades of unique experience in high conflict custody cases, many of which involve allegations of physical, emotional, or sexual abuse. He is also well-versed in helping families with complicated assets including large businesses and complex estates.
He began his law career working for the City of Phoenix Prosecutor’s Office, trying criminal cases before juries and judges. In 2005, Jason pivoted into family law and has since worked to resolve a wide variety of family law cases, from simple to demanding.
Before becoming a family lawyer, Jason was a social worker for ‘at-risk’ children. During his 20 year legal career, he has served as a court appointed advisor for family law court, a parenting coordinator, a judge pro tempore, and in various leadership roles with State and County bar associations.
His combined education and experience has provided him with a comprehensive understanding of child development and the law, both of which powerfully inform his practice as a family law attorney.

SENSIBILITY. We emphasize reasonable expectations and help our clients be pragmatic. We go far beyond feelings of 'right and wrong' to share the logical, potential benefits and costs of every strategy... then we work with clients to determine the most appropriate plans of action.
A. A minimum of 60 days is required in Arizona...however, depending on the number of issues in each case, it can take years.
Q. How much will this cost?
A. It depends on how much is being fought about...the longer the case, the more expensive it is. My most expensive case billed at nearly 1 million dollars in fees and took two years to resolve.
Q. Who gets the house?
A. Assuming it is community property, this is negotiated between the parties. At the end of the case, if an agreement cannot be reached between the parties, the court will require the house be sold and the net proceeds be divided equally.
Q. Do I have to let the other parent see the kids?
A. Yes; unless you believe you can prove they are a danger to the emotional, physical, and psychological development of the children. Withholding children without cause will be held against you in court.
Q. Who is going to pay the bills?
A. Typically, they will be paid similarly to how they were paid during the marriage. However, at temporary orders, this is one issue that should be decided if the customary payment arrangement is in question.
Q. Do I have to share my bonus?
A. Maybe. Is the bonus being paid for prior services conducted during the marriage? Then yes. Is the bonus being paid to retain you as an employee moving forward? Then it may be your separate property.
Q. Can I travel to see family?
A. Yes. The preliminary injunctions preclude out-of-state travel without the other parent's permission, but if it can be agreed upon, travel is allowed. Once the decree is final, however, it should outline acceptable travel details.
Q. Does he/she get my social security?
A. No. However, if you were married for more than 10 years, your spouse may be able to use your contributions to increase their own social security payments.
