  • $975,000 - Wrongful Death
The decedent was driving through Virginia on his way from his old home in New York to his new home in Florida. The crash occurred in the early morning on Interstate 95, when the decedent slowed for traffic ahead and was struck in the rear by the defendant’s vehicle. At the time of the wreck, the defendant was driving a rented box truck. The violent force of the impact pushed the decedent’s vehicle forward and under the rear of a tractor-trailer that had stopped in front of his vehicle. The decedent was killed instantly, and a passenger in his vehicle sustained serious injuries. Further investigation uncovered the fact that the defendant had barely slowed before striking the decedent’s vehicle, consumed illegal drugs within 24 hours of the incident, had recently been texting, and let his personal auto insurance policy lapse. This case was settled for $975,000. Mr. Kessel was also able to successfully resolve the passenger’s claim for injuries she sustained in the wreck.
