Lawyer Case History

In re Marriage of Weekes, 459 P.3d 1216 (Colo.App.2020)

Affirmed in part and reversed in part.  The Colorado Court of Appeals held that the trial court properly applied CRS section 14-10-122(5) limiting retroactive support for a mutual aged upon change to 5 years from the date of the filing od the motion to modify.  However, the Court sent the matter back to the trial court to hold a hearing.

In re N.J.C., 467 P.3d 1209 (Colo.App.2019)

The Colorado Court of Appeals affirmed the trial court holding that Father's deferred comp was not income for purposes of calculating child support because it was not available for Father's discretionary use.

In re Marriage of Chalat, 112 P.3d 47 (Colo. 2005)

The Colorado Supreme Court affirmed the Colorado Court of Appeals holding that post secondary education support is modifiable upon a showing of a substantial and continuing change in circumstances, but overturned the Court of Appeals holding that Mr. Chalat was entitled to a modification of his post secondary educational support obligation, holding that he had failed to establish a substantial and continuing change in circumstances.

In re Marriage of Chalat, 94 P.3d 1191 (Colo. App. 2004)

The Court of Appeals held that a post secondary educational support agreement entered into by the parties prior to 1991 is modifiable upon a showing of a substantial and continuing change in circumstances.

In re Marriage of Talbott, 43 P.3d 734 (Colo. App. 2002)

The Court of Appeals held that the three day extension for mailing under C.R.C.P. 6 was applicable to a Motion for Review filed under the Colorado Rules for Magistrates.
