Jacqueline Garcell is a partner and trial attorney at Lipcon, Margulies & Winkleman, P.A. in Miami, Florida. Her practice focuses on Admiralty and Maritime Law and Personal Injury Litigation - Plaintiffs, with an emphasis on representing cruise ship passengers, crew members, and individuals injured in maritime and non-maritime accidents. She handles cases involving cruise ship injuries, sexual assault claims, wrongful death matters, shore excursion accidents, and other complex personal injury litigation.
Ms. Garcell became one of the firm’s youngest partners after beginning her career with Lipcon, Margulies & Winkleman, P.A. as a summer associate and law clerk before joining the firm as an attorney in 2013. Since then, she has represented clients in matters involving cruise line negligence, unsafe ship conditions, crew member injuries, and transportation-related accidents connected to shore excursions.
Over the course of her career, Ms. Garcell has helped recover compensation for hundreds of clients through settlements and verdicts involving maritime and personal injury claims. Her results include a verdict recognized among the Top 50 Personal Injury Verdicts in Florida in 2017.
Representative matters include:
- $2.6 million recovery for a cruise ship passenger injured in a ship waterpark area. The case involved allegations that the cruise line failed to follow its own safety procedures requiring crew supervision in the area where the incident occurred.
- Multiple confidential settlements exceeding $1 million in sexual assault cases. Ms. Garcell has represented passengers and crew members in claims involving allegations of sexual assault and violent misconduct aboard cruise ships.
- Confidential settlements in shore excursion transportation accident cases. She has handled claims arising from bus accidents involving cruise passengers traveling to excursions arranged through cruise lines, pursuing claims against cruise companies, excursion operators, and transportation providers.
- Confidential settlements in crew member injury cases. Ms. Garcell has represented injured cruise ship employees in matters involving workplace injuries and allegations of delayed or inadequate medical care.
