Greg Hersen is a partner and Co-Chair of the Construction Law Group at Torkin Manes LLP in Toronto, Ontario. Greg advises public and private sector clients on construction and infrastructure matters throughout all stages of a project. His clients include owners, general contractors, sureties, subcontractors, suppliers, and design professionals involved in transit systems, bridges, highways, flood management and erosion control projects, recreational infrastructure, healthcare and educational facilities, commercial and residential developments, industrial projects, and mining developments.
His Construction Law practice includes advising on delay claims, tender disputes, construction liens, deficiencies, contract termination and abandonment, extras, negligence claims, surety bonds, indemnity agreements, COVID-19 related claims, breaches of trust, prompt payment matters, and holdback release issues under Ontario’s Construction Act. Greg represents clients in litigation before trial and appellate courts and regularly assists clients through negotiation, mediation, and arbitration proceedings.
Greg was the first lawyer appointed to the Canadian Construction Documents Committee (CCDC), where he participated for more than a decade in the revision and development of standard construction industry documents, including stipulated price, civil works, construction management, and design-build contracts. He also advises clients on drafting and negotiating tender documents, construction contracts, and professional service agreements, as well as contract administration and compliance matters.
A frequent speaker on Construction Law developments, Greg presents seminars and continuing legal education programs on topics including construction management and design-build contracts, delay claims, CCDC documents, construction liens, and payment bond claims. He has spoken for organizations including the Ontario Bar Association, the Law Society of Ontario, and the Canadian Bar Association.
