Graham Gerhardt represents financial institutions in civil litigation throughout the country. He regularly assists clients in both the forward mortgage and reverse mortgage industries. Graham frequently litigates in federal court where he defends lenders and loan servicers accused of violating federal statutes, most commonly TILA, RESPA, the FDCPA, the FCRA, and the TCPA. He also represents clients in state court, defending against claims such as wrongful foreclosure, fraud and deceptive trade practices. Graham oversees these suits through all stages of the legal process, including bench trials, jury trials and frequent depositions and mediations.
In addition, Graham’s practice often involves representing his clients when they are faced with title conflicts and disputes over lien priority, and thus he routinely advises clients in their dealings with taxing authorities, title insurers and homeowners’ associations.
Before focusing on the representation of financial institutions, Graham gained diverse experience as both a litigator and a counselor. During the first several years of his practice, he handled a broad spectrum of matters for clients large and small. Among other litigation matters, Graham defended his clients against employment suits, products liability claims, wrongful death lawsuits, and suits brought by railroad workers pursuant to the Federal Employers’ Liability Act.
