Workers' Compensation Law - Claimants

Biography

Originally from Prairie Village, Kansas, George Pearson has practiced Workers Compensation Law for the past 35 years representing clients all over the state of Kansas. Specializing in legal representation for injured workers in workers compensation cases he has earned a reputation for compassionate legal services and a tenacity to get the job done for his clients as efficiently as possible. The law is not built for speed and certainly whether the workers compensation system or the District Court for a jury trial in a personal injury case, George Pearson is known for aggressively pushing and moving the case through the system to resolution whether by settlement or trial, and overcoming the stalling tactics of insurance companies and their minions.

George's tenacity earned him the nickname "Bulldog" among his peers in the early years of his legal career. He has not mellowed with time and experience but that experience and connections he has made during his career have frequently allowed him to resolve cases sooner rather than later. Receiving the highest ranking by AVVO Legal at 10 out of 10 and with consistent 5 Star Reviews from clients, George Pearson is recognized as a talented lawyer who represents his clients zealously and who takes pride in clients who are happy with his services and the results he obtains for them.

George's fees for his services are reasonable and no fee is ever charged unless a recovery is obtained. In workers compensation cases the fee is the state-approved 25% fee and in motor vehicle accident cases it is the pretty standard in the industry 33% contingency fee. There is never a fee unless a recovery is obtained on behalf of the client and the client has the ultimate authority to decide whether a settlement offer is good enough to accept.

George Pearson graduated from the Washburn University School of Law and has lectured other lawyers in the field of workers compensation and ethics and has authored articles for other lawyers pertaining to workers compensation.

Q&A

If you hire me as your lawyer, your file is not handed off to somebody else to handle. I handle your case along with my support staff and you talk to me about your case and our strategy on how to obtain the best result, nobody else.

How long will my case take?
What is my case worth?

I can give general answers to these questions but it is not something that any lawyer can answer with specificity at the first meeting or conversation. Every case is different and a cookie cutter approach is not reasonable or appropriate to handle these cases which require knowledge and experience to know what to do to get the best result in each individual case.

This is an easy one because this was the most memorable of many memorable cases this year. A young woman driving nursing home patients for an excursion out of the facility was hit head-on by a school bus that was making an illegal left hand turn bringing it into my client's path. We opened the workers compensation case and she got her back surgery and other medical treatment and received disability payments for almost 2 years. In addition to the workers compensation claim, we intended to file suit against the bus driver and bus company after medical treatment in the workers compensation concluded. The pandemic we have all been living through resulted in the closing of in-person schools as the country went to internet schooling and the before suit was filed the bus driver died of causes unrelated to the accident which injured my client. We opened an estate for the bus driver because we had to sue the deceased bus driver's estate to be able to recover from the bus company for an accident that happened in the course of the bus driver's employment. We litigated the case against the bus company to a mid 6 figure settlement and were very glad to get it because the bus company was on the verge of bankruptcy due to the pandemic closing down its business. We were successful in getting the workers compensation insurance carrier to waive its lien so that nothing had to be repaid to it for the medical treatment and disability payments it had paid that created a lien against the recovery in the case against the bus company. I had a great client who was very happy with the result we obtained and it was a win-win situation because the bus company did end up declaring bankruptcy and had we not settled when we did for a very substantial amount of money we would not have recovered anything due to the bankruptcy.

It is always a challenge moving cases along as fast as you want them to go. The Judge controls his or her schedule and there is considerable delay built into the system. My greatest challenge is moving things along and not letting the defense or legal system bog them down.

I got into the area of workers compensation representing injured workers early in my legal career and it was a great fit. I am a people person and like to help people who are facing adversity.

I love to play golf (not great but not horrible, like most golfers somewhere in between) and love playing with my 7 and 11 year old. We have recently become avid fishermen/fisherwomen since building a house on a lake. We love to horseback ride and mind our farm.
