Biography

Gary M. Stein is Co-Managing Partner of Peckar & Abramson PC’s Miami, Florida office and serves on the firm’s Executive Committee. He also serves as general counsel to the South Florida Chapter of the Associated General Contractors of America (South Florida AGC).

Gary is certified by The Florida Bar in Construction Law and represents general contractors, construction managers, subcontractors, owners, developers, and other construction industry participants. His practice focuses on Commercial Litigation, Construction Law, and Litigation – Construction, including matters involving litigation, arbitration, and mediation. He regularly handles construction and design defect claims, contract disputes, construction liens and surety bond claims, delay and inefficiency claims, acceleration claims, insurance disputes, and related issues arising from residential, commercial, and public projects.

His experience includes representing civil infrastructure contractors in disputes involving tunnels, bridges, roadways, and highways, as well as energy infrastructure contractors in matters related to power generation facilities, including nuclear projects. Gary also advises clients involved in joint venture disputes, assisting with JV agreements, risk allocation, and dispute resolution strategies for large commercial and infrastructure developments.

In addition, Gary assists clients with the preparation and negotiation of construction contracts and provides project administration guidance during construction to help identify and address potential disputes at an early stage.

Gary has represented clients in state and federal courts, as well as in domestic and international arbitrations, in matters involving delays, liens, bonds, wrongful termination, differing site conditions, and construction defects. These matters have involved a wide range of building systems and components, including foundations, reinforced and post-tension concrete, masonry, roofing, drywall assemblies, stucco, EIFS, curtain wall systems, railings, coatings, mechanical, electrical, plumbing, fire suppression systems, drilled shafts, and other structural and building elements.

As lead counsel, Gary has handled jury and non-jury trials, arbitrations, and appeals. He has also served for many years as an arbitrator with the American Arbitration Association and as a mediator in complex construction and commercial disputes.

Gary teaches a course on legal issues in construction for the Master of Construction Management Program at the University of Miami School of Architecture. He has authored numerous articles on construction-related topics for publications including Southeast Construction and organizations such as the American Bar Association and the American Arbitration Association. He also regularly speaks at seminars and educational programs for industry and legal organizations, including the National Business Institute, Lorman Educational Services, the Florida Construction Law Institute, and the Miami-Dade County Bar Association.
