Erwin J. Shustak is the Founder and Managing Partner of Shustak Reynolds & Partners PC in San Diego, California. He leads the firm’s Litigation and Arbitration Department and has more than four decades of experience representing clients in complex business disputes and financial matters throughout the United States and internationally. His practice focuses on Commercial Litigation and Financial Services Regulation Law, including disputes involving securities, financial institutions, and business transactions.
Mr. Shustak represents public and private companies, financial institutions, broker-dealers, registered investment advisers, advisory firms, securities brokers, government agencies, hedge funds, investment partnerships, manufacturers, and investors. Over the course of his career, he has handled and supervised hundreds of litigations and arbitrations in federal and state courts as well as arbitration forums across the country.
His work includes matters involving securities and financial fraud, business torts, breach of contract claims, real estate disputes, employment conflicts, unfair competition, non-compete and restrictive covenant issues, and intellectual property disputes such as copyright and trademark infringement. In addition to courtroom and arbitration proceedings, Mr. Shustak frequently assists clients with negotiation and resolution of complex commercial disputes.
Mr. Shustak began his legal career at Kaye Scholer Fierman Hays & Handler in New York City. He is admitted to practice before the state and federal courts of California, New York, and New Jersey, as well as the United States Courts of Appeals for the Second, Third, Fifth, and Ninth Circuits and the United States Supreme Court.
For more than 25 years, Mr. Shustak has served as an arbitrator for FINRA, the Financial Industry Regulatory Authority (formerly the National Association of Securities Dealers), and the National Futures Association. He is a member of the Association of Trial Lawyers of America, the Association of Business Trial Lawyers of San Diego, the New York State Bar Association, the California Lawyers Association, and the San Diego County Bar Association. He also participates in the Legal and Compliance Society of SIFMA, the Securities Industry and Financial Markets Association.
Mr. Shustak is involved with IR Global, an international association of legal and accounting professionals based in London that provides the firm with connections to professionals in jurisdictions around the world. He serves on the organization’s Disputes Committee.
