Biography

Denis Douville is an associate and trademark agent with Fasken’s intellectual property group. His practice encompasses the full spectrum of intellectual property law, including contractual, regulatory, and litigation work across a variety of industries. Denis handles patent, copyright, trademark, and trade secret matters for clients across diverse sectors, such as high-technology, gaming, fashion, and pharmaceuticals.

Denis regularly advises clients on the commercialization and protection of intellectual property, in both business-to-business (B2B) and consumer facing (B2C) arrangements. He has negotiated licensing, sublicensing, design, development, and service agreements, as well as manufacturing and distribution agreements, among other deals. His contract work spans a variety of fields and subject matter, including software as a service (SAAS), open source software (OSS), online platforms, digital currencies, data sharing, e-wallets, virtual assets, blockchain, Internet service provision (ISP), telecommunications services, and multimedia streaming. He has negotiated agreements with major brands for clothing and fashion accessories, and has advised on the intellectual property and tech aspects of M&A transactions across multiple sectors, including information technology platforms, payment processing, environmental risk mitigation, and health sciences.

As a trademark agent, Denis helps clients obtain and manage trademarks and trademark portfolios in Canada and internationally. He has advised on trademark availability, complex prosecution questions, and trademark disputes (at both the administrative and court level). He has been involved in opposition and cancellation proceedings, as well as Internet domain name conflicts. He has experience in online enforcement of intellectual property rights, combatting online fraud and impersonation, and takedowns of infringing and illicit websites and social media accounts.

In his litigation practice, Denis has been involved in litigating intellectual property, regulatory, and constitutional matters. He has been involved in disputes concerning contractual obligations and royalty payments. His patent litigation experience includes disputes concerning technology and methods that incorporate artificial intelligence (AI).

Denis is a member of Fasken’s video game industry group. He has provided counsel regarding copyright, trademark, consumer protection, and regulatory issues facing both large and small videogame studios. His videogame practice includes videogame development, social media applications, and online platforms.

Denis is also a member of Fasken’s regulatory affairs in life sciences group. He has been involved in assessing supply, distribution, intellectual property transfers, and licensing within the pharmaceutical sector.
