David appears before all levels of courts including the Superior Court of Justice of Ontario, the Ontario Court of Justice,The Ontario Court of Appeal, the Federal Court of Canada Trial and Appeal Divisions and the Supreme Court of Canada. He has appeared before a wide variety of federal and provincial tribunals boards commisisions and public inquiries, such as both the Ontario and Canadian Human Rights Tribunals, The Canadian International Trade Tribunal, The Commercial Registration Appeal Tribunal of Ontario, The Ontario Municipal Board and the Ontario Special Education Tribunal.
David was lead Counsel to the Catholic Church at the highly publicized, four year long Cornwall Public Inquiry (2005 to 2009) which investigated historical allegations of abuse by persons in positions of authority.
David has a broad litigation practice which involves commercial litigation, defamation (libel and slander) in the context of print, radio and television and internet publications, access to court proceedings and publication bans, media defence work, construction, public procurement, municipal litigation, insurance cases in the fields of property, professional liability and construction and personal injury in the area of sexual abuse.
David Acts is a regular adviser to a number of major municpalities in Ontario in relation to a braod spectrum of litigation issues affecting municipal interests.
David also has significant experience acting on behalf of and defending Canadian Charitable Corporations. In this regard, has appeared before all levels of Courts in cases involving the deregistration of charities by the Canada Revenue agency, breach of trust and fidcuciary duty, fundraising contracts, disputes between charities and foundations and governace disputes.
David acts as both counsel and an advisor to both major institutions and suppliers in the filed of public procurement. He has been counsel on a series of improtant procurement cases before the Ontario courts and some of the largest procurement disputes involving the federal government before the Candian International TradeTribunal. He was recognized as a leader in this field by Best Lawyers in 2010 and 2011.
David has been very significanlty involved in providing pro bono litigation services, typically to children or young adults affected by developmental or cognitive issues.He has for years been recognized as a leading advocate for children and young adults in this area. In 2010 David was awarded the LEXPERT Zenither Gold Award : Disability Change Agent as a result of providing pro bono litigation services to disabled children.
David has sat as a board memeber for the Autism Society of Ontario, the Ottawa School of Art, the School of Dance of Ottawa and as a member of the Ottawa Carleton Catholic School Board's Special Education Advisory Committee.
