David L. Alberti is a co-founder of Alberti Lim & Tonkovich LLP in Foster City, California. He is a trial lawyer who represents patent owners and technology companies in complex patent litigation and intellectual property disputes. With more than two decades of experience, David handles matters in U.S. district courts, the U.S. Patent and Trademark Office, and the U.S. International Trade Commission.
David represents clients throughout patent disputes, including pre-filing strategy, discovery, claim construction, trial, appeal, and post-grant proceedings. He has served as lead trial counsel and lead patent counsel in matters involving computer architecture and software, encryption and security systems, wireless communications and devices, microprocessors and memory systems, storage networks, semiconductor fabrication and design, mechanical and electromechanical systems, consumer electronics, optical systems, automotive systems and components, and related technologies.
His patent litigation practice includes district court and appellate proceedings, ITC investigations, arbitrations, and proceedings before the Patent Trial and Appeal Board, including inter partes review proceedings. David also advises clients on patent portfolio diligence, valuation, licensing, monetization, and acquisition-related issues connected with intellectual property disputes and business objectives.
David’s litigation activity has been noted in independent industry publications. In Patexia’s 2023 Patent Litigation Intelligence Report, he was included among the 50 best-performing and most active patent litigation attorneys in the United States based on work from 2017 through 2022. In Patexia’s 2025 PTAB Intelligence Report, he was included among the 50 active and performing attorneys representing patent owners.
Before co-founding Alberti Lim & Tonkovich LLP, David was a patent litigation partner at an international law firm. In that role, he represented clients in complex, multi-forum disputes involving parallel district court, PTAB, and ITC proceedings. His approach combines trial preparation, technical analysis, and practical case management tailored to each client’s legal and business objectives.
