Biography

Attorney David P. Hollander is a skilled trial and appellate partner in Stafford Rosenbaum’s Madison office. He has represented clients in an array of complex disputes across a dozen states. David’s commercial practice focuses on business, real estate, intellectual property, and administrative or constitutional disputes. As Co-Chair of the firm’s Election and Political Law team, David also litigates ballot access, recount, election administration, voting rights, and democracy cases.

David’s varied client base has included family businesses, manufacturers, software developers, law firms, private equity firms (and other lenders or investors), healthcare institutions, higher education institutions, political parties, and civic organizations. He has also represented local government bodies and elected officials from each of Wisconsin’s three branches of government.

David regularly serves as local counsel for substantial litigation matters pending in state or federal court in Wisconsin. David offers his co-counsel practical insight, strategic thinking, attention to detail, and above-average tours of the Wisconsin State Capitol building.

David is an adjunct faculty member at the University of Wisconsin Law School, where he teaches Trial Advocacy. He also frequently publishes content on legal issues that he finds interesting or important. In addition to Stafford Rosenbaum’s legal blog, David’s writing has been featured on the cover of Wisconsin Lawyer magazine twice, in Law360.com, and in the State Bar of Wisconsin’s Books Unbound publication.

David’s notable successes include:

  • Cross-examined majority shareholder in successful federal shareholder oppression trial, leading to a substantial money judgment against the majority shareholder, appointment of a receiver, and dissolution of the corporation.
  • Served as second chair attorney in a successful four-day product liability bench trial on behalf of a U.S. military housing contractor who purchased 1,500+ units of the defective product.
  • Obtained dismissal of counterclaims in a trademark infringement suit where the defendant alleged the infringed-upon trademarks were invalid and secured through fraud on the USPTO.
  • Represented elected official in successful challenge to opponent’s placement on ballot based on opponent’s constitutional ineligibility to hold office; obtained court order reversing Wisconsin Elections Commission’s decision on emergency basis after Commission unlawfully placed candidate on ballot.
  • Conducted 15+ employee-witness interviews on behalf of a higher education institution as part of a successful response to a False Claims Act case and an inquiry by the institution’s accrediting body.
  • Contributed to litigation team that enjoined certain Wisconsin election regulations as unconstitutional in light of COVID-19 in April 2020, which resulted in approximately 80,000 ballots counting when they otherwise would have been disqualified.
