David West represents banks, trust departments, businesses, nonprofit organizations, and individuals in disputes involving trusts and estates, banking matters, business conflicts, and property-related litigation. Based in San Antonio, Texas, he focuses his practice on Litigation - Banking and Finance, Litigation - Trusts and Estates, Commercial Litigation, and Non-Profits at Caldwell Clark Fanucchi & Finlayson PLLC.
Board Certified in Civil Trial Law by the Texas Board of Legal Specialization, Mr. West has handled more than 50 jury and non-jury trials and arbitrations in both federal and state courts. His litigation experience includes matters involving fiduciary disputes, financial institution litigation, business torts, contract disputes, trust and estate litigation, and complex commercial claims.
In addition to his litigation practice, Mr. West advises banks and financial institutions on issues involving account ownership and rights, powers of attorney, check fraud, ACH and wire fraud, elder fraud, and matters arising under the Uniform Commercial Code. He regularly counsels clients on risk management and dispute resolution involving banking and fiduciary relationships.
Mr. West has been recognized by The Best Lawyers in America each year since 2011 and by Texas Super Lawyers each year since 2009. He previously served as head of the Litigation Department and as a member of the Management Advisory Committee at Cox & Smith Incorporated. He also served in the office of firm counsel for Cox & Smith and later Dykema Gossett, PLLC, where he practiced for more than 30 years.
His professional involvement includes service as Chair of the San Antonio Bar Association Litigation Section and as a member of the Board of Directors of the San Antonio Bar Association.
Before entering private practice, Mr. West served as a law clerk to The Honorable Thomas M. Reavley of the United States Court of Appeals for the Fifth Circuit and The Honorable Jack Roberts of the United States District Court.
