Biography

Christopher J. Kutner represents managed care organizations, physician groups, hospitals, and ancillary service providers, including laboratories, health care benefit administrators, and suppliers of medical equipment. His practice focuses on Health Care Law and Litigation – Health Care, advising clients across the health care industry on regulatory, compliance, and enforcement matters.

Chris regularly represents health care providers facing audits, investigations, and enforcement actions by government agencies, including the New York State Department of Health’s Office of Professional Medical Conduct (OPMC), the New York State Medicaid Inspector General (OMIG), the U.S. Department of Health and Human Services’ Office of Inspector General (OIG), the New York Attorney General, and the U.S. Attorney’s Offices throughout New York and New Jersey. He also counsels providers on managed care contracting, dispute resolution, and the development of compliant practice structures, including issues related to referrals and permissible financial arrangements.

A partner at Rivkin Radler LLP in Uniondale, New York, Chris is a member of the firm’s Compliance, Investigations & White Collar and Health Services Practice Groups. He began his legal career as a commercial litigator, representing local, national, and international companies in complex civil litigation in state and federal courts.

In 1998, Chris transitioned to an in-house counsel role with Vytra Health Plans, a managed care organization he previously represented. During his eight-year tenure, he developed and implemented Vytra’s first corporate compliance program and served as compliance and privacy officer. He later acted as special assistant and counsel to the president and chief executive officer, advising on health care strategic planning, product development, and regulatory compliance. Chris also served as corporate counsel and regulatory compliance counsel for Vytra’s parent organization, HIP, and as general counsel to Vytra, where he worked closely with state and federal law enforcement on investigations involving health care fraud and related matters.
