Biography

Chuck N. Kunz is a partner at Morris James LLP in Wilmington, Delaware. For nearly 25 years, he has represented secured and unsecured creditors, asset purchasers, trustees, lenders, and other parties in bankruptcy matters and commercial litigation in courts across the country, with a substantial focus on Delaware state and federal courts.

Chuck’s practice includes Delaware bankruptcy and insolvency law and bankruptcy litigation. He advises clients in Chapter 11 proceedings, bankruptcy-related litigation, preference and fraudulent transfer actions, creditor rights disputes, and matters involving non-bankrupt debtors. His litigation experience includes jury and bench trials involving contract disputes, commercial tort claims, and other complex business matters.

In addition to his bankruptcy and litigation practice, Chuck co-chairs the firm’s Data Privacy and Information Governance Group. He counsels businesses on privacy compliance, data security, information governance, incident response, data management, and fiduciary considerations involving the collection, use, and protection of information. He is a Certified Information Privacy Professional/US (CIPP/US) and a member of the International Association of Privacy Professionals (IAPP), the Technology Forum of Delaware, and The Richard K. Herrmann Technology American Inn of Court.

Chuck frequently writes and speaks on bankruptcy, privacy, cybersecurity, data governance, and developments in Delaware law. He has authored articles for the American Bankruptcy Institute Journal and regularly presents on issues affecting businesses, creditors, and technology-related legal risks.
