Litigation - Labor and Employment

Biography

Brian Carnie focuses his practice on representing management in litigation and counseling matters involving labor and employment law. Based in Shreveport, Louisiana, he works with employers across a wide range of industries to address workforce challenges that affect daily operations, compliance, and long-term business objectives. At Kean Miller, Brian provides practical legal guidance designed to help employers plan for, anticipate, and respond to both routine and unexpected human resources issues.

Brian regularly defends employers in state and federal courts and before administrative agencies in matters involving wrongful discharge, discrimination, harassment, retaliation, workplace torts, breach of contract, FMLA, and OSHA whistleblower claims. His litigation experience also includes Fair Labor Standards Act disputes, collective and class wage and hour actions, and Americans with Disabilities Act access cases, often referred to as “drive-by” or “Google” lawsuits. His recognized practice areas include Litigation – Labor and Employment.

In addition to litigation, Brian advises employers on disability and leave management, internal investigations involving allegations of sexual harassment, workforce reorganizations and reductions in force, wage and hour audits, worker classification issues, and I-9 compliance. He represents management in collective bargaining negotiations, union grievances, and arbitrations, and counsels businesses on lawful strategies to address union organizing activity.

Brian also assists employers with understanding and complying with requirements under the Affordable Care Act. His work includes advising on employer responsibilities, compliance testing, reporting and notice obligations, and representing employers in challenges to IRS ACA penalty notices and related appeals.

Clients value Brian’s responsive and practical approach to legal problem-solving. He communicates complex legal issues in a clear and business-focused manner, helping employers make informed decisions that reduce risk and support effective workforce management. His attention to detail and thoughtful analysis support clients navigating sensitive employment matters and high-stakes litigation.

Before entering private practice in Louisiana, Brian practiced management-side employment law for more than ten years in Chicago, Illinois. He also served as an attorney for the Louisiana Second Circuit Court of Appeals, where he assisted appellate judges with motions, civil and criminal writs, criminal appeals, and post-conviction matters, and acted as a legal advisor to the Clerk of Court.

This experience within the appellate court system continues to inform Brian’s approach to litigation and counseling today. His understanding of appellate procedure and court operations allows him to anticipate procedural issues, evaluate risk, and develop well-reasoned legal strategies for employers throughout Louisiana and beyond.
