- Cause No. 2005-41785; In the Interest of Kaydence Jade Page, A Child; In the 309th Judicial District Court of Harris County, Texas.
This was a case that invloved the modifcation of conservatorship, multiple enforcement actions, some torts and an appeal of the asscoaite jusdges ruling. My client went into this suit having restricted possession and access of their daughter. At the conlcusion of the case he was awarded sole managing conservatorship, the mother was given restricted rights of possession and we were able to recover actual and exemplary damages for tortious interference of cusotdy.

This was case involving two enforcement actions (one for property and one for child support), a request for the court to divide property that was not divided at divorce, a breach of contract claim and a claim for breach of one''s fiduciary obligation. We were victorious on all issues. What made this case so important was that it focused on the determination of the existance of a fiduciary relationship post divorce. Now a bankruptcy has been filed by the other side in an attempt to discharge the judgments and contempt punishment. We are exploring and preparing a fraud claim to present in the bankruptcy court.
